3. User Obligations

6. Limitation of Liability

To the fullest extent permitted by applicable law, North Ink Studio Ltd. will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from:

• Your access to or use of (or inability to access or use) the Site
• Any conduct or content of any third party on the Site
• Unauthorized access, use, or alteration of your transmissions or content

In no event will North Ink Studio Ltd.'s total liability for direct damages exceed CAD $100 or the amount you paid to North Ink Studio Ltd. for services in the 3 months immediately preceding the event giving rise to the claim, whichever is greater (unless a different cap is required by law).

You agree to defend, indemnify, and hold harmless North Ink Studio Ltd., its directors, officers, employees, contractors, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with:

• Your violation of these Terms
• Your infringement of any intellectual property or other rights of any person or entity

If informal resolution is not successful, disputes will be resolved in the courts of Toronto, Ontario, Canada, unless applicable law requires a different forum.

We may suspend or terminate your access to the Site at any time if we reasonably believe you have violated these Terms, attempted to compromise the Site's security, or used the Site unlawfully. Termination may be immediate and without notice where necessary to protect the Site or other users.
